The terms governing use of this website and the provision of port agency, husbandry, and maritime services by Marine Trust Shipping Agencies & Maritime Affairs Co. S.A.E.
These sections set out important limitations on Marine Trust's liability and confirm that all PDA estimates issued via this website are proforma and non-binding until confirmed in writing. By using this website or requesting services, you accept these terms.
These Terms and Conditions (“Terms”) govern your use of www.marinetrusteg.com (the “Website”) and the provision of port agency, vessel husbandry, terminal coordination, and related maritime services by Marine Trust Shipping Agencies & Maritime Affairs Co. S.A.E. (“Marine Trust,” “we,” “us,” “our”) to any ship owner, operator, charterer, or representative (“Client,” “you”). By accessing this Website, submitting an enquiry, requesting a PDA estimate, or engaging Marine Trust for services, you agree to be bound by these Terms.
By accessing or using this Website, submitting any form (including the General Enquiry or PDA Estimate Request forms), or engaging Marine Trust for port agency, husbandry, or related services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you should not use this Website or request services from Marine Trust.
These Terms apply in addition to, and do not replace, any separate written agency agreement, letter of appointment, or service contract entered into between Marine Trust and a Client for a specific vessel call or service engagement. Where a conflict exists between these Terms and a signed agency agreement, the signed agreement shall prevail.
Marine Trust provides port agency, vessel husbandry, terminal coordination, bunkering supervision, customs clearance, and related maritime services across Egyptian ports, as described on this Website. Service descriptions on this Website are provided for general information purposes and do not constitute a binding offer of service. Actual scope of work, fees, and terms for any specific vessel call are confirmed separately through written correspondence, a signed appointment letter, or a Final Disbursement Account.
You agree to use this Website only for lawful purposes connected to genuine enquiries regarding maritime services. You agree not to:
Marine Trust reserves the right to refuse service, remove submitted content, or restrict access to this Website at its discretion, without prior notice.
All Proforma Disbursement Account (PDA) estimates, cost indications, or service quotations provided through this Website, by email, or verbally are proforma estimates only and do not constitute a binding offer or contract.
PDA figures are based on standard tariffs and typical port conditions at the time of issue. Actual costs in the Final Disbursement Account (FDA) may vary due to factors including but not limited to: changes in port authority tariffs, actual vessel stay duration, weather delays, additional services requested by the Client or master, stevedore performance, customs requirements, or force majeure events.
A PDA becomes a binding service commitment only upon written confirmation by Marine Trust of vessel nomination and acceptance of the engagement. No PDA, whether issued through this Website or otherwise, obligates Marine Trust to perform services until such written confirmation is provided.
Marine Trust acts solely as agent for the Client (ship owner, operator, or charterer) in arranging and coordinating port services in Egypt. Marine Trust does not itself perform stevedoring, pilotage, towage, customs inspection, port authority operations, or other third-party services — these are carried out by independent port authorities, stevedoring companies, pilots, customs officials, and other third-party providers operating under their own statutory or contractual authority.
Accordingly, Marine Trust shall not be liable for:
Marine Trust’s liability, where it arises from its own proven negligence or wilful default in the performance of its agency duties, shall be limited to the agency fee paid by the Client for the specific service in question, unless otherwise agreed in writing.
When requesting a PDA estimate or engaging Marine Trust for services, the Client agrees to:
Marine Trust’s agency fee covers the scope of services agreed for a specific vessel call, as set out in the PDA or signed appointment. Port disbursements (port authority charges, pilotage, towage, stevedoring, government fees, and similar third-party costs) are passed through to the Client at actual cost, supported by receipts and documentation where applicable.
Final settlement is due in accordance with the payment terms confirmed at the time of appointment. Marine Trust reserves the right to withhold release of cargo documentation or final clearance pending settlement of outstanding disbursements, where permitted under Egyptian law and standard maritime agency practice.
All content on this Website — including text, logos, graphics, and design elements — is the property of Marine Trust Shipping Agencies & Maritime Affairs Co. S.A.E. or its licensors and is protected under applicable Egyptian and international intellectual property law. No part of this Website may be reproduced, distributed, or used for commercial purposes without prior written permission from Marine Trust.
These Terms, and any service engagement between Marine Trust and a Client, shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, including but not limited to Egyptian maritime law (Law No. 8 of 1990 and related port and maritime regulations).
Any dispute arising out of or in connection with these Terms or the services provided by Marine Trust shall be subject to the exclusive jurisdiction of the competent courts of Alexandria, Egypt.
Marine Trust may revise these Terms from time to time to reflect changes in our services, applicable Egyptian law, or operational practice. The “Last updated” date at the top of this page indicates when these Terms were last revised. Continued use of this Website or engagement of Marine Trust’s services following any update constitutes acceptance of the revised Terms. Terms applicable to a specific, already-confirmed service engagement remain those in effect at the time that engagement was confirmed in writing.
